AJSA Announcement Seating Capacity for Towing in Queensland

This one seems to crop up at the start of each season.


Its a little confusing as different states = different rules.


Here is the bottom line in Queensland.


Question: Do I need to have a seat or the capacity within my PWC or boat for the person/s being towed?
 
No, a water-skier or person/s on a tube is a person that has made a decision to be in the water. They are obviously capable to be in the water for a reasonable period, they can support themselves and they are wearing a lifejacket. The tube, board or ski also provides them an additional level of comfort albeit in some cases not a lot of flotation. The main point is they are intending on being in the water not on the boat/PWC. They are not entering the water unexpectedly. If they do get on the boat or PWC then the boat/PWC needs to be able to carry them within the capacity.

Also it is no longer considered safe in Queensland to count kids under 12 as a half a person. Each person needs a seat regardless of age.

So from the MSQ website...

You should:

- operate your PWC only with the child seated behind you, never between you and the handle bars
- only have passengers who can place both feet at the same time firmly in the foot wells of the PWC
- have the correct number of people on board for the number of seats available. It is no longer considered safe to count children under 12 years of age as half a person. Three seats means 3 people - no matter the age.

Operating outside of these points may leave you liable to prosecution in regards to your general safety obligations, under Transport Operations Marine Safety Regulation

Ok, so my question is this, is this "best practice" (ie should) or is this law (ie must)?  Its a bit ambiguous. dno

Yes you should wear protective clothing whilst riding a motorbike, but legally you don't have to....

I regularly ride the ski around lakes and rivers with my primary aged children and my wife on board...

Guess I'll just have to put the kids in the tube and tow them over to Straddie...  awsm
